Terms of Service

Acceptance

By signing up for or using HEIMDALL (heimdall.projectaesir.com), you agree to these Terms. If you do not agree, do not use the service.

Your Account

You are responsible for keeping your credentials secure and for all activity under your account. You must be at least 13 years old. Provide accurate registration information; we may suspend or terminate accounts that violate these terms.

Acceptable Use

You agree not to:

• Use HEIMDALL for unlawful purposes or in violation of any applicable law.
• Attempt to access other tenants' data, gain unauthorized access, or circumvent rate limits / authentication / billing.
• Reverse-engineer the platform or its APIs for the purpose of building a competing service.
• Use HEIMDALL to harass, threaten, or harm any person or business.
• Misrepresent the source of outbound communications.
• Harvest data from HEIMDALL for resale.

Outbound Email Compliance

HEIMDALL sends emails on your behalf using credentials you provide. You are solely responsible for ensuring every email complies with all applicable anti-spam and data-protection laws, including (without limit) the US CAN-SPAM Act, Canada's CASL, the EU GDPR, the UK GDPR, Australia's Spam Act 2003, and any state-level laws like CCPA.

Concretely, you must:

• Have a legitimate business reason for contacting each recipient.
• Include a working unsubscribe mechanism on every outbound message.
• Honor unsubscribe requests immediately.
• Identify yourself accurately in From / Reply-To headers.
• Not use deceptive subject lines or sender names.

HEIMDALL provides tools to help (built-in unsubscribe links, lint warnings), but compliance is your responsibility.

OAuth Connections

When you connect a third-party account (TikTok, Instagram, YouTube, LinkedIn, X) via OAuth, you grant HEIMDALL limited read-only access to the public profile data covered by the scopes shown on the provider's consent screen. HEIMDALL never posts, messages, follows, or takes any action on your behalf. You may disconnect from Settings at any time; doing so revokes our token and removes the cached profile data.

Payment & Subscriptions

Paid HEIMDALL plans are billed per the rate sheet shown at signup. Subscriptions auto-renew at the end of each billing period unless cancelled at least 24 hours before renewal. Refund requests are handled case-by-case; contact us within 14 days of a charge.

Intellectual Property

HEIMDALL software, designs, and branding are the property of AESIR. You retain ownership of any data you upload or input. By using HEIMDALL, you grant us a limited license to host, process, and display your data solely to deliver the service to you.

Warranty Disclaimer

HEIMDALL IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, AESIR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE LEADS WILL CONVERT, EMAIL DELIVERY WILL SUCCEED, OR THAT THIRD-PARTY DATA RETURNED IS ACCURATE.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, AESIR'S AGGREGATE LIABILITY UNDER OR RELATED TO THESE TERMS IS LIMITED TO THE AMOUNTS YOU PAID AESIR IN THE 12 MONTHS PRECEDING THE CLAIM. AESIR IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

Termination

You may stop using HEIMDALL at any time. We may suspend or terminate your access for violation of these terms, non-payment, abuse of third-party APIs, or to comply with legal requirements. Sections on IP, Warranty Disclaimer, Limitation of Liability, and Governing Law survive termination.

Governing Law

These Terms are governed by the laws of the United States and the state of the principal AESIR office, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located there.
